Terms and Conditions

General Terms and Conditions for SkillEvade

1. Scope

These General Terms and Conditions apply to all contracts concluded through the SkillEvade online shop between the provider and consumers.

SkillEvade offers a digital service involving VPN, routing and location adjustment for gaming purposes. The service is designed in particular for use in connection with online games.

Any differing terms of the customer do not form part of the contract unless the provider expressly agrees to their application.

2. Contracting parties

The contract is concluded between the customer and SkillEvade, acting through the natural or legal person named in the legal notice.

Customers within the meaning of these Terms and Conditions are consumers who use the service predominantly for private purposes.

3. Scope of services and terms of use

3.1. The provider supplies the customer with a digital VPN, routing and location adjustment service intended for gaming purposes. The specific service is set out in the relevant product description in the online shop.

3.2. The service may include features such as VPN connections, split tunneling, location selection, routing features or lobby information. The precise range of features may vary depending on the selected product, technical availability and stage of development.

3.3. The service is currently in a beta phase. During this phase, individual features may be restricted, operate incorrectly, be temporarily unavailable or behave differently depending on the customer's individual system environment.

3.4. Use of the service may be affected in particular by operating system settings, firewalls, antivirus programs, Windows Defender, router settings, internet service providers, third-party software, game providers, platform operators or other technical circumstances.

3.5. Selecting a VPN location or routing option does not mean that a game provider, platform or matchmaking system will necessarily assign the customer to that location. No particular lobby region, server assignment, IP recognition, ping improvement, matchmaking effect or circumvention of regional assignments is guaranteed unless expressly promised in the product description.

3.6. SkillEvade is not affiliated with game providers, platform operators or other third parties unless expressly stated. Trademarks, game names and platform names are used solely to describe possible areas of application.

3.7. Use of the service is permitted solely for lawful gaming purposes. The customer must comply with applicable laws, third-party rights and the terms of use of the relevant games, platforms and services.

3.8. The provider offers support through the Discord server linked on the website or through other support channels made available by the provider.

4. Formation of the contract

4.1. The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

4.2. The customer makes a binding offer by completing the ordering process in the online shop and submitting the order.

4.3. The contract is formed as soon as the provider accepts the order. Acceptance may occur in particular through an order confirmation, payment confirmation, provision of access or activation of the service.

4.4. For new website orders, the provider stores the accepted Terms and Conditions, withdrawal instructions and the contract acceptance actually given as a versioned record of the order. The customer receives these texts and the recorded declarations with the contract confirmation by email. The customer should retain this confirmation. No new declaration is attributed to earlier orders.

5. Term, renewal and termination

5.1. The customer may choose between the subscription terms offered in the online shop. These may include in particular terms of 1 month, 3 months, 6 months or 12 months.

5.2. Payment is made in advance for the selected initial term.

5.3. After the selected initial term expires, the subscription continues for an indefinite period unless it is terminated in good time. After the initial term expires, the customer may terminate the subscription at any time on no more than one month's notice.

5.4. Termination may be made using the termination function provided in the online shop, through the customer account, by email or in text form.

5.5. If the customer does not specify a particular termination date when giving notice, then, in cases of doubt, termination takes effect at the earliest permissible date.

5.6. Both parties' right to extraordinary termination for good cause remains unaffected.

6. Prices and payment terms

6.1. The prices stated in the online shop are final prices in euros, including statutory VAT where applicable.

6.2. Accepted payment methods are those stated in the online shop, in particular credit card, PayPal or other payment services available through the shop.

6.3. Payment is due at the beginning of the respective term.

6.4. In the event of late payment, a failed payment, chargeback, payment dispute or an open buyer protection case with a payment provider, the provider may temporarily restrict or suspend access to the service until the payment matter has been clarified.

6.5. Access will be suspended only to the extent necessary for investigation, protection or prevention of further harm. The customer's statutory rights remain unaffected.

7. Right of withdrawal

7.1. Consumers have a statutory fourteen-day right of withdrawal. The complete withdrawal instructions and model form describe the period, notification and consequences.

7.2. Your access becomes available immediately after successful activation. If you validly withdraw from a new website order within the statutory withdrawal period, the provider reimburses the payments received in full and does not deduct a proportionate charge for use already made. Activating or using your access does not automatically end your statutory right of withdrawal.

7.3. Accepting these Terms and Conditions does not constitute a blanket waiver of your statutory right of withdrawal.

7.4. These terms do not replace the separate withdrawal instructions. Statutory withdrawal and defect rights remain unaffected.

8. Availability, maintenance and beta phase

8.1. The provider endeavours to provide the service with as little disruption as possible. However, continuous availability at all times is not guaranteed.

8.2. Temporary restrictions may arise in particular from maintenance, updates, technical faults, security measures, server failures, network problems, force majeure or circumstances beyond the provider's control.

8.3. During the beta phase, features may be tested, adjusted, expanded, restricted or temporarily disabled.

8.4. The customer's statutory rights in the event of failure to supply, restricted supply or defects in the digital service remain unaffected.

8.5. Updates to Call of Duty may temporarily restrict VPN functionality. If such an update affects our VPN service, SKILLEVADE guarantees restoration of the affected VPN functionality within 72 hours after publication of that Call of Duty update. The general qualifications in sections 8.1–8.3 do not limit this specific undertaking. Statutory rights in the event of failure to supply or defects, including available price reduction, termination and damages, remain unaffected; the customer is not required to waive these rights or wait beyond a statutory deadline.

9. Rights in respect of defects and warranty

9.1. Statutory rights in respect of defects apply to digital products and digital services.

9.2. The service is free from product defects if, at the relevant time, it meets the contractually agreed requirements and the statutory requirements.

9.3. Unless expressly promised, the provider does not owe any particular effect on third-party services, game servers, matchmaking systems, lobby regions, IP recognition, ping values or platform decisions.

9.4. The provider does not guarantee that the service is fully compatible with every individual system environment, software application, game, platform or network.

9.5. In the event of technical problems, the customer should contact support and allow the provider a reasonable opportunity to investigate and remedy the problem, insofar as this can reasonably be expected. The customer's statutory rights remain unaffected.

10. Customer obligations to cooperate

10.1. The customer must provide the technical prerequisites necessary for use on their device and in their network environment.

10.2. The customer must keep access credentials confidential and must not disclose them to third parties.

10.3. The customer must not use the service for unlawful purposes, attacks on networks, fraud, spam, copyright infringement, circumvention of statutory restrictions or other misuse.

10.4. The customer is responsible for complying with the terms of use of the games, platforms and third-party services they use.

11. Misuse, suspension and payment disputes

11.1. The provider may temporarily suspend or restrict the customer's access where there are reasonable grounds to suspect misuse, unlawful use, a breach of these Terms and Conditions, a threat to the technical infrastructure or an unresolved chargeback, payment dispute or ongoing buyer protection case.

11.2. When suspending access, the provider will take the customer's legitimate interests into account and limit the suspension to what is necessary.

11.3. In the event of serious or repeated breaches, the provider may terminate the contract for good cause.

11.4. The customer's statutory rights, in particular rights in respect of defects or withdrawal, remain unaffected.

12. Refunds and goodwill

12.1. Refunds are made in accordance with the statutory provisions, in particular in the event of effective withdrawal, justified termination of the contract, price reduction or other statutory claims.

12.2. Voluntary refunds outside statutory entitlements are made only after an individual assessment and as a gesture of goodwill. There is no entitlement to a voluntary goodwill refund.

12.3. Mere failure to achieve a desired result, in particular a specific lobby region, server assignment, IP recognition, ping improvement or matchmaking effect, does not automatically give rise to a refund entitlement, provided the service has otherwise been supplied in accordance with the contract.

12.4. If the customer initiates a chargeback, payment dispute or buyer protection case through a payment provider, further clarification will generally take place through that payment provider. Duplicate refunds are excluded.

12.5. The customer's statutory rights remain unaffected.

13. Liability

13.1. The provider has unlimited liability for damage arising from injury to life, body or health caused by a breach of duty by the provider, its legal representatives or persons employed in performing its obligations.

13.2. The provider also has unlimited liability for damage caused by intent or gross negligence on the part of the provider, its legal representatives or persons employed in performing its obligations.

13.3. In the event of a slightly negligent breach of material contractual obligations, the provider is liable only for foreseeable damage typical of the contract. Material contractual obligations are obligations whose fulfilment is essential to the proper performance of the contract and on whose observance the customer may regularly rely.

13.4. In all other respects, the provider's liability is excluded.

13.5. Liability under the German Product Liability Act and other mandatory statutory liability provisions remains unaffected.

14. Data protection

The provider processes the customer's personal data in accordance with the applicable data protection provisions. Further information is set out in the provider's separate privacy policy.

15. Changes to the Terms and Conditions

15.1. The provider may amend these Terms and Conditions with effect for the future where there is an objective reason for doing so and the amendment is reasonable for the customer.

15.2. The customer will be notified of material changes in good time.

15.3. Changes do not apply retroactively to contractual relationships already concluded unless the customer has validly consented or there is a statutory basis for the change.

16. Final provisions

16.1. The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.

16.2. Should individual provisions of these Terms and Conditions be wholly or partly invalid, the validity of the remaining provisions is unaffected. The statutory provisions take the place of the invalid provision.

16.3. The contract language is German.
